vingt-cinq siecles, et c'est pour cela qu'il ne se gouverne plus comme il
se gouvernait.
l'histoire de la grece et de rome est un temoignage et un exemple de
l'etroite relation qu'il y a entre les idees de l'intelligence
humaine et l'etat social d'un peuple. regardez les institutions des
anciens sans penser a croyances, vous les trouvez obscures,
bizarres, inexplicables. si, en remontant aux premiers ages de cette race,
c'est-a-dire au temps ou elle fonda ses institutions, on l'idee
qu'elle se faisait de l'etre humain, de la vie, de la mort, de la seconde
existence, du principe divin, on un rapport intime entre ces
opinions et les regles antiques du droit prive, entre les rites qui
deriverent de ces croyances et les institutions politiques. |

la comparaison des croyances et des lois montre qu'une religion primitive
a constitue la famille grecque et romaine, a le mariage et
l'autorite paternelle, a les rangs de la parente, a le droit
de propriete et le droit d'heritage. cette meme religion, apres avoir
elargi et etendu la famille, a une association plus grande, la cite,
et a en elle comme dans la famille. d'elle sont venues toutes les
institutions comme tout le droit prive des anciens. mais
avec le temps ces vieilles croyances se sont modifiees ou effacees; le
droit prive et les institutions politiques se sont modifiees avec elles.
alors s'est deroulee la serie des revolutions, et les transformations
sociales ont suivi regulierement les transformations de l'intelligence.
il faut donc etudier avant tout les croyances de ces peuples. les plus
vieilles sont celles qu'il nous importe le plus de connaitre. car les
institutions et les croyances que nous trouvons aux belles epoques de la
grece et de rome, ne sont que le developpement de croyances et
d'institutions anterieures; il en faut chercher les racines bien loin dans
le passe. les populations grecques et italiennes sont infiniment plus
vieilles que romulus et homere. |

une antiquite sans date, que les croyances se sont formees et que les
institutions se sont ou etablies ou preparees.
mais quel espoir y a-t-il d'arriver a connaissance de ce passe
lointain? qui nous dira ce que pensaient les hommes, dix ou quinze siecles
avant notre ere? peut-on retrouver ce qui est si insaisissable et si
fugitif, des croyances et des opinions? nous savons ce que pensaient les
aryas de l'orient, il y a -cinq siecles; nous le savons par les
hymnes des vedas, qui sont assurement fort antiques, et par les lois de
manou, ou l'on peut distinguer des passages qui sont d'une epoque
extremement reculee. mais, ou sont les hymnes des anciens hellenes? ils
avaient, comme les italiens, des chants antiques, de vieux livres sacres;
mais de tout cela, il n'est rien parvenu jusqu'a nous. |

peut bien l'oublier, mais il le garde toujours en lui. car, tel qu'il est
a chaque epoque, il est le produit et le resume de toutes les epoques
anterieures. s'il descend en son ame, il peut retrouver et distinguer ces
differentes epoques d'apres ce que chacune d'elles a en lui.
observons les grecs du temps de pericles, les romains du temps de ciceron;
ils portent en eux les marques authentiques et les vestiges certains des
siecles les plus recules. le contemporain de ciceron (je parle surtout de
l'homme du peuple) a 'imagination pleine de legendes; ces legendes lui
viennent d'un temps tres-antique et elles portent temoignage de la maniere
de penser de ce temps-la. le contemporain de ciceron se sert d'une langue
dont les radicaux sont infiniment anciens; cette langue, en exprimant les
pensees des vieux ages, s'est modelee sur elles, et elle en a
l'empreinte qu'elle transmet de siecle en siecle. |

radical peut quelquefois reveler une ancienne opinion ou un ancien usage;
les idees se sont transformees et les souvenirs se sont evanouis; mais les
mots sont restes, immuables temoins de croyances qui ont disparu. le
contemporain de ciceron pratique des rites dans les sacrifices, dans les
funerailles, dans la ceremonie du mariage; ces rites sont plus vieux que
lui, et ce qui le prouve, c'est qu'ils ne repondent plus aux croyances
qu'il a. mais qu'on regarde de pres les rites qu'il observe ou les
formules qu'il recite, et on trouvera la marque de ce que les hommes
croyaient quinze ou vingt siecles avant lui.. .. |
